This writ petition under Article 227 of Constitution of India has been filed by the petitioners with the prayer to quash the impugned order dated 6.9.2019 passed by learned Sessions Judge, Jaunpur in Criminal Revision No. 169 of 2019, Kamlesh vs. Dayaram, and the order dated 31.8.2019 passed by S.D.M., Badlapur, Jaunpur in Case No. 03013 of 2018, Computer Case No. T201814360203013, Kamlesh Chandra vs. Daya Ram, under Section 133 Cr.P.C., Heard learned counsel for the petitioners and learned A.G.A. for the State. Perused the record.
Only submission made by the counsel for the petitioners before the Court is that there is some application dated 05.9.2019 seeking stay moved before the court below but no orders have been passed on the same so far. Therefore, some direction to get the application decided may be issued by this Court.
This Court in the absence of complete record is not in a position to know about the exact status of the proceedings or the reasons of delay in disposal of the said application, if there is any such application moved on behalf of the petitioners. At any rate, if the submission made by the counsel is correct and if there is some application dated 5.9.2019 pending before the court below awaiting its adjudication, it may be observed that the court below is required to pass appropriate orders on the same as it may deem fit and proper expeditiously in according to law.
With the aforesaid observation, this writ petition stands disposed off.
