Heard learned counsel for the petitioner.
This writ petition is by the wife of the Pradhan and has been filed alleging that the Pradhan has been making application for removal of encroachment over Gaon Sabha property, but no action has been taken by the respondent authorities.
The Pradhan who is alleged to have filed the application for removal of encroachment has not come forward in this writ petition. The writ petition by his wife who has no locus in the facts and circumstances to maintain this writ petition.
The writ petition under the circumstances, is sheer abuse of the process of the Court and is dismissed with cost of Rs. 5,000/- to be deposited within a month, failing which the same shall be recovered as arrears of land revenue.
