Heard Sri Dileep Singh Yadav, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
The present application under Section 482 Cr.P.C. has been filed by the applicant with the prayer to direct the Court below to expedite the trial of Case No. 39544 of 2017 (State Vs. Ashok Kumar @ Sanad and others), arising out of Case Crime No. 311 of 2009, under Sections 302, 342, 376 of I.P.C., P.S. Sachendi, District Kanpur Nagar, pending in the Court of Special Chief Judicial Magistrate, Kanpur Nagar, within a stipulated period.
Learned counsel for the applicant submits that the applicant is first informant in the aforesaid case crime. It is submitted that no matter is pending before this Court. Despite issuance of non- bailable warrant against the accused persons, they are not turning up on account of which the trial is moving at a snail's pace.
In view of above, without expressing any opinion on the merits of the case, the Special Chief Judicial Magistrate, Kanpur Nagar is directed to adopt all stern action for securing the attendance of the accused persons and expedite the aforesaid trial and conclude the same as expeditiously as possible, as per provisions of the law itself.
With the aforesaid observations, the present application under Section 482 Cr.P.C. application is finally disposed of.
