Heard learned counsel for the petitioner.
The present writ petition has been filed seeking following relief:
"It is therefore most respectfully prayed that this Hon'ble Court may graciously be pleased to allow present application and set aside the judgement and decree dated 12.09.2008 & 16.09.2008 respectively (Ax.8) passed by the Special Judge (E.C. Act), Banda in S.C.C. Revision No. 03/2007 and or pass such other and further order which this Hon'ble Court may deem fit."
The present writ petition has been filed after a lapse of more than 13 years.
Learned counsel for the petitioner submits that the petitioner was under treatment at Medanta Hospital, Lucknow and as such she could not approach this Court within reasonable time.
After having heard learned counsel for the petitioner and going through the record, I do not find good and sufficient grounds given by the petitioner in the instant petition in approaching this Court at such belated stage. The delay/laches has not been explained satisfactorily. No document has been annexed to establish that the petitioner was under treatment and she was confined in a hospital from 26.02.2010.
The present writ petition is liable to be dismissed on the ground of laches.
