Heard learned counsel for the petitioner, learned standing counsel for respondent no.1 and Mohd. Shere Ali for respondent no.2.
The petitioner, which is an educational institution, claims that it had filed an application on 5.7.2017 before respondent no.2, Basic Shiksha Adhikari, Maharajganj seeking recognition of the institution under the Right of Children to Free and Compulsory Education Act, 2009. Since the application has not been disposed of so far and hence the instant writ petition seeking a mandamus commanding the second respondent to accord consideration to the said application.
Sri Mohd. Shere Ali, learned counsel appearing on behalf of respondent no.2 states that the application, if not already decided, shall be decided within a period of twelve weeks.
Accordingly, the instant writ petition is disposed of by directing respondent no.2 to decide the application of the petitioner institution seeking recognition under the provisions of the Right of Children to Free and Compulsory Education Act, 2009 in accordance with law, preferably within a period of three months from the date of production of a certified copy of this order.
