HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12843 of 2004 Date: August 26, 2014 Between:
1. Kamineni Madhusudhan & 4 others.
… Petitioners and
1. The Mandal Revenue Officer, Sulthanabad Mandal, Karimnagar District & another.
… Respondents * * * HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12843 of 2004 O R D E R:
The petitioners were allotted house plots by the Mandal Revenue Officer, Sultanabad Mandal, Karimnagar District. The cause for grievance in this writ petition was that the respondent authorities were trying to interfere with their possession over such house plots.
2. By order dated 23.07.2004, this Court directed that the petitioners should not be dispossessed from the subject property.
3. The Mandal Revenue Officer, Sultanabad, filed a counter admitting that the petitioners were issued house site patta certificates in respect of certain extents of land in Survey No.229 of Poosala Village of Sultanabad Mandal in the year 1999. He however stated that the authorities never interfered with their possession over the house plots.
4. In the light of the aforestated averments in the counter-affidavit, it is clear that the petitioners approached this Court on a mere apprehension and that there was no cause for grievance as such.
5. The writ petition is accordingly closed. Needless to state, in the event the authorities wish to proceed against the petitioners in respect of the subject house plots, they would have to do so in accordance with the due procedure laid down by law. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
