Heard Mr. T.P. Dubey,learned counsel for applicants and learned AGA for State.
At the very outset, learned counsel for applicants contends that he be permitted to correct prayer clause of this application as due to inadvertence the date 28.7.2020 has been transcribed in place 11.9.2019.
Prayer made is bonafide. Accordingly same is allowed.
Let necessary corrections in prayer clause of this application be made by learned counsel for applicant during course of day.
At very outset, learned AGA has raised preliminary objection by submitting that non-bailable warrants were issued against applicant vide order dated 11.9.2019. As such on date approximately one year and ten months have rolled by from the date of passing of order dated 11.9.2019 but applicants have not appeared before court below as yet. Consequently, proceedings of above mentioned sessions trial have remained held up on account of non-cooperation of applicant. As such applicants do not deserve any indulgence of this court.
When confronted with aforesaid, learned counsel for applicants could not overcome the same.
In view of above, no occasion arises before this Court to entertain this application.
Accordingly, present application fails and is hereby dismissed.
