Heard Mr. Ashutosh Shukla, learned counsel for the petitioners and the learned A.G.A. for the State.
This petition under Article 227 of the Constitution of India has been filed challenging the order dated 16.07.2018 passed by the Additional Sessions Judge, Court No. 02, Varanasi in Criminal Revision No.34 of 2017 (Dinesh Kumar Patel Vs. State of U.P. and others) whereby the revisional court has allowed the aforesaid criminal revision and remanded the matter before the Magistrate concerned to redecide the issue qua the summoning of the accused, i.e., petitioners herein.
From the perusal of the order impugned passed by the revisional court, this Court does not find any illegality or infirmity in the aforesaid order.
The present petition under Article 227 of the Constitution fails and is accordingly dismissed.
