K.Ambili Kumari vs Kerala State Road Transport ...

High Court Of Kerala|31 August, 1998

JUDGMENT / ORDER

The petitioner is an unmarried daughter of Sri.Madhavan Nair who retired from service of the respondent Corporation. Claim of the petitioner is for payment of Family Pension in view of Ext.P1 Government order, which is adopted by the respondent Corporation through Ext.P2. The petitioner had submitted Ext.P5 representation before the Managing Director of the respondent Corporation seeking to consider her claim and to take appropriate decision allowing Family Pension from 01-01-2001 onwards. Since no decision has been taken inspite of several requests made, this writ petition is filed seeking appropriate direction.
2. Heard; Sri. Babu Joseph Kuruvathazha, standing counsel appearing for the respondent. Considering the facts and circumstances, I am of the view that interests of justice W.P.(c) No.24382/2012 -2- will be served if a direction is issued to the Managing Director of the respondent Corporation to take appropriate decision on the basis of Ext.P5 within a time limit.
3. Therefore the writ petition is disposed of directing the Managing Director of the respondent Corporation to consider Ext.P5 and to take an appropriate decision thereon, after affording an opportunity of personal hearing to the petitioner, at the earliest possible, at any rate within a period of one month from the date of receipt of a copy of this judgment.
4. Needless to say that necessary steps will be taken for disbursal of the amounts if it is found that the petitioner is eligible for Family Pension.
