COMMON ORDER:
These two Civil Revision Petitions are filed under Article 227 of the Constitution of India against the orders dated 03.07.2014 passed in I.A.Nos.141 & 143 of 2014 in O.S.No.134 of 2009 on the file of the Court of the Junior Civil Judge, Jangareddigudem.
Heard the learned counsel appearing for the petitioners/defendants and the learned counsel appearing for the respondent/plaintiff.
The petitioners/defendants filed two petitions, one is to reopen the plaintiff’s side evidence and another is to recall PW 1 for cross examination with regard to the age of the 4th defendant and with regard to suppression of fact that the father of defendants 1 to 3 being alive.
The trial Court dismissed the said two petitions on the ground that an amendment was already made by the plaintiff with the permission of the Court correcting the age of the 4th defendant and other aspects. The revision petitioners were afforded an opportunity to cross examine the witness by the trial Court and there was no necessity to further cross examine the witnesses of the plaintiff on the aforesaid aspects. The order impugned being in accordance with law, having regard to the facts and circumstances of the case, does not warrant any interference and hence these two Civil Revision Petitions are dismissed. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed in consequence.
