JUDGMENT / ORDER

The learned counsel for the respondent has placed his submissions as early as on 31.01.2017 and since then, the matter has been adjourned periodically for the submissions of the appellant. Though sufficient time was given, the learned counsel for the appellant has neither entered appearance nor placed his submissions. Therefore, this matter has been listed today under the caption ?for dismissal?.
2. Today, at about 11.00 a.m., when the matter was taken up for hearing, there was no representation for the appellant. However, it was passed over and at about 01.00 p.m., when the matter was taken up for hearing, again there was no representation for the appellant. In such circumstances, this Court has no other option except to dismiss the second appeal for non- prosecution.
3. Accordingly, the second appeal is dismissed for non-prosecution. No costs. Consequently, connected civil miscellaneous petition is closed.
