This transfer application has been filed by the learned counsel for the applicant praying for transfer of Case No. 715/12/14, under Section 125 Cr.P.C. (Nasrin Bano and other Vs. Kamar @ Kasim) and Misc. Case No. 91/11/15 (Nasrin Bano and others Vs. Kamar @ Kasim), under Section 128 Cr.P.C., Police Station Fatehgarh, District Farrukhabad, pending in the court of Principle Judge, Family Court, Fatehgarh, to any other District.
Submission is that objection to the application under Section 128 Cr.P.C. filed by the opposite party Nos.2 and the application under Section 126 (2) filed by the applicant is pending before the Principal Judge, Family Court, Farrukhabad, but no order has been passed. Therefore, he has approached this Court to transfer proceedings of the aforesaid case to some other court in any other District.
This application for transfer of proceeding is misconceived. However, the trial court is expected to decide the aforesaid applications within one month from the date of production of certified copy of this order.
With the aforesaid observations, this application stands disposed of.
