The wife's claim for maintenance under Section 125 CrPC has been rejected by impugned order dated 16.05.2018 passed by the learned Additional Sessions Judge/FTC-2016, Mahoba in Case No.94 of 2017 (Smt. Kamar Jahan Vs. Ahsanulhaq). The wife has approached this Court against the said order in revision saying that the order impugned is passed taking into consideration irrelevant material, ignored from consideration relevant materials and evidence and drawn perverse conclusion.
Matter requires consideration.
Issue notice to the opposite party no. 2 returnable in three weeks.
List on the date fixed in the notice.
Learned CJM, Mahoba is directed to ensure that opposite party no.2 is served in all events and further that return is available to this Court by the date fixed.
Let lower court record be summoned at once by the office which shall be made available to this Court positively by the date fixed.
