Heard Sri Prakash Chandra Srivastava (A.O.R. No.A/P-0320 holding brief of Sri Ravi Shankar Yadav, learned counsel for the petitioner and the learned Standing Counsel for the respondents.
The petitioner in the writ petition states that his daughter, who was admitted in the hospital being run by the respondent no.4, died and later on he came to know that the respondent no.4- doctor was not medically qualified and has never been registered as medical practitioner. He therefore prays that action may be taken against the respondent no.4 as well as stop running of the hospital. In this regard he is also stated to have lodged an F.I.R. dated 15.01.2019, copy of which has been filed as annexure-1 to the writ petition.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.3, District Magistrate, District Jaunpur to examine the matter and pass appropriate orders in accordance with law within a period of two months from the date a certified copy of this order is received in his office. Needless to say before any order is passed he shall also give an opportunity of hearing to the respondent no.4.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
