Heard learned counsel for the parties.
The petitioner has filed the present petition stating that her son Krishna died on account of coming in contact with electric wire on 12.8.2018. The First Information Report was lodged on 12.8.2018 itself. It has further been stated that in the post mortem conducted the cause of death was ascertained as due to electric burning, in fact, the Executive Electric Distribution Division 4th Tehsil Kirawali, District Agra, vide his letter dated 25.8.2018 (Annexure-4 to the writ petition) has recommended the Executive Engineer for suitable action on the application filed on behalf of the petitioner for compensation on account of death of her son due to electric burning. It has also been stated that the petitioner has filed an application before the respondent no. 3 for compensation under the National Family Benefits Scheme, however, the same has not been decided till date, the petitioner being poor lady is being made to suffer on account of non-discharge of statutory duty by the respondents.
From the averments made in the writ petition, it is clear that the son of the petitioner died on 12.8.2018 and the application seeking compensation is lying pending since then and it is expected that all the authorities have to pass some order on the said application.
In view of the facts mentioned here-in-above, we direct the respondent no. 3 and the Executive Engineer, Electric Distribution Division 4th Tehsil Kirawali, District Agra (respondent no. 4) to pass a reasoned order on the application of the petitioner, forwarded on 23.8.2018, vide letter no. 2479 (Annexure 4 to the petition) before the respondent no. 4 as well as the application dated 5.9.2018 filed before the respondent no. 3 (Annexure-7 to the writ petition) within two months from the date of production of a certified copy of this order in accordance with law.
The writ petition is disposed off.
