Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This bail application under Section 439 Cr.P.C. has been moved by the accused-applicant Kamal, who is involved in Case Crime No. 494 of 2016, under Section 8/20 N.D.P.S. Act, Police Station - Ramgarh, District - Firozabad.
Learned counsel for the applicant contended that the applicant was enlarged on bail vide order of Additional Sessions Judge, Court No. 3, Firozabad dated 16.09.2016. Due to illness of his father, he could not appear before the trial court, due to which non-bailable warrant was issued against him on 21.11.2016.
Per contra, learned A.G.A. has opposed the prayer for bail.
Without commenting on the merits of the case, considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.
Let the applicant - Kamal be released on bail in the aforesaid case crime number on his furnishing a personal bond and two heavy sureties of the like amount to the satisfaction of the court concerned.
