Heard learned counsel for the petitioners and learned Standing Counsel for the respondents no.1 to 3.
In view of the nature of the order proposed to be passed, it is not necessary to issue any notice to the respondent no.4.
The petitioners are seeking a direction to the respondents to grant financial approval to the appointment of the petitioners on the post of Assistant Teacher in Shri Bhoot Nath Mauni Swami Sanskrit Uttar Madhyamik Vidyalaya Lauganwa Kumhiyawan, Kaushambi.
The selection for the post of Assistant Teacher was held in which the petitioners were selected and thereafter the selection papers were forwarded by the Committee of Management of the Institution in question to the District Inspector of School, District Kaushambi through his letter dated 4.5.2018 (Annexure No.11) but it is stated that till date no decision has been taken.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.3, District Inspector of School, District Kaushambi to take a decision with regard to grant of approval to the appointment of the petitioners, on the post of Assistant Teacher, within a period of two months from the date a certified copy of this order is received in his office.
It is made clear that the Court has not adjudicated the claim of the petitioners on merits, and all questions are left open to be examined by the authority concerned, in accordance with law.
