This application is filed by the applicant-under trial prisoner through his wife seeking temporary bail for a period of 30 days on the ground of ailment of his daughter aged three years, who is hospitalized for convulsion and brain-fever and further except the wife of the applicant, no other member in the family is available to take care of his daughter. The certificate issued by the Medical Officer is verified by the In-charge Senior Police Inspector, Shahibaug Police Station, Ahmedabad City.
Considering overall facts and circumstances as stated, the applicant is ordered to be released by granting temporary bail for a period of 10 days from the date of release on furnishing personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the Jail Authority and he shall mark his presence before the nearest Police Station on every alternate day during the period of temporary bail. On completion of the temporary bail, the applicant shall report to the Jail Authority. The application is allowed accordingly.
Rule is made absolute. Direct service is permitted.
