The petitioner is stated as a joint owner in possession of 2 cents of property, along with her nephew, R.Sasikumar, in Survey No.129/24 of Nooranad Village. Grievance is regarding Ext.P2 notice issued by the 1st respondent with regard to the proceedings pursued at the instance of respondents 1 & 3 to draw electric line through the property belonging to the petitioner, which is opposed by way of Ext.P3 objection dated 29.05.2014. A subsequent notice was issued by the 1st respondent vide Ext.P4 to appear on 24.09.2014. No final order has been served till date. Apprehending coercive proceedings without even serving a copy of the order, the petitioner has approached this Court by filing this writ petition.
2. Heard the learned standing counsel appearing for the respondent Board as well as the learned Government Pleader appearing for the 1st respondent.
3. It is brought to the notice of this Court that, the proceedings are still to be finalised and that the cause of action is premature. It is stated that, the proceedings will be finalised only after passing an order after hearing all the parties W.P(C). No. 25623 of 2014 -2-
concerned.
4. In the above circumstances, the writ petition is disposed of directing the 1st respondent to pass appropriate orders in accordance with law, after hearing all the parties concerned. A copy of the order shall be served to the petitioner as well. The undertaking made by the learned standing counsel for the respondent Board that, no electric line will be drawn before finalisation of the proceedings and serving a copy of the order to the petitioner, is recorded.
The petitioner shall serve a copy of this judgment along with a copy of this writ petition to the 1st respondent for further steps.
Disposed of accordingly.
