Heard learned counsel for the petitioner, Shri Sanjai Singh, counsel for the respondent-Bank and learned Standing Counsel for the State- respondents.
Admittedly petitioner has defaulted in repayment of an agricultural loan taken from the respondent- Bank. A recovery certificate for recovering of Rs. 10,56,740/- has been issued to him.
Counsel for the petitioner states that he is ready to deposit the whole amount in easy installments.
Learned counsel for the respondent-Bank has no objection to the amount being deposited in installments.
Under the circumstances, this petition is disposed of with the following directions:
(i) Petitioners may deposit the entire amount sought to be recovered in eight equal quarterly installments. The first installment shall necessarily be deposited within a period of one month from today.
The recovery proceedings, during this period shall be kept in abeyance. In case petitioners commit default in depositing any of the installments within the stipulated time, it will be open to the respondents to adopt coercive process for recovery of the entire amount due which will not be objected to by the petitioner.
The writ petition stands disposed of with the aforesaid directions.
