Heard Sri A.K. Shukla, learned Advocate appearing for the petitioner, Sri K.B. Srivastava appearing for respondent nos. 1 and 2 and perused the record.
By means of this petition under article 226 of the constitution, the petitioner seeks a direction in the nature of mandamus to the respondent no. 3 to decide the pending application of the petitioner dated 15.3.2019 moved under section 70 (1) of the U.P. Co-operative Societies Act, 1965.
Learned counsel appearing for respondent nos. 1 and 2 submits that the Registrar has the power to look into the grievance of the petitioner in purported exercise of his power under section 70 (1) of the Act of 1965.
In such view of the matter and the fact that the application of the petitioner has remained pending since 15th March, 2019, the respondent no. 3 is directed to dispose of the pending application/representation of the petitioner under section 70 (1) of the U.P. Co-operative Societies Act, 1965 as expeditiously as possible preferably within a period of three months from the date of production of a certified copy of the order. It is, however, provided that before passing the final order proper opportunity of hearing to all the concerned party shall be afforded by the third respondent.
We further clarify that we have not adjudicated the claim of the petitioner on merits.
The writ petition stand disposed of.
