Heard learned counsel for the petitioner.
The instant petition has been filed against the order dated 04.09.2018 passed by the Principal Judge, Family Court, Badaun in Misc. Case No. 98 of 2018 by which the application of the petitioner under Order 9 Rule 13 C.P.C. along with delay condonation application has been rejected.
Against such an order passed by the Family Court an appeal would lie under Section 19 of the Family Courts Act. Accordingly, this petition is disposed of with liberty to the petitioner to file an appeal against the order, if so advised.
The certified copy of the enclosures may be returned to the learned counsel for the petitioner upon obtaining photocopies thereof.
