1. The present Civil Application u/s.5 of the Limitation Act has been preferred by the applicant herein - original plaintiff to condone delay of 139 days in preferring the Second Appeal challenging the impugned judgement and orders passed by both the Courts below.
2. Having heard Mr.A.N.Patel, learned advocate appearing on behalf of the applicant herein and Mr.Suresh Bhatt, learned advocate for M/s.HL Patel Advocates appearing on behalf of the respondents and considering the averments in the application to condone the delay and as sufficient cause has been shown, delay caused in preferring the Second Appeal is hereby condoned. Rule is made absolute accordingly. Registry is directed to notify main Second Appeal for admission-hearing on 02/07/2012.
