When the matter is called out, none is present for the applicant. Learned APP has submitted that in view of the fact that the prisoner applicant had misused the earlier leave and absconded for long time of 4042 days, this application may not be entertained.

The court is of the view that the tendency evinced by the prisoner does not deserve any exercise of discretion in his favour. The matter therefore is required to be rejected and is rejected on the sole ground. The prisoner be informed accordingly.
