Present Civil Revision Application against the impugned order passed by the learned trial court for inventory and appointment of Court Commissioner and to prepare Panchnama, cannot bes aid to be an order finally determining the rights of the parties and therefore, the present Civil Revision Application under section 115 of the Code of Civil Procedure would not be maintainable.
Under the circumstances, present Civil Revision Application is dismissed as not maintainable without further entering into the merits of the matter and without expressing any opinion on merits. It will be open for the petitioners to initiate appropriate proceedings against the order impugned in the present Civil Revision Application and as and when such proceedings are initiated, the same be considered in accordance with law and on merits.
