Kalpesh Naginbhai Patel vs State Of Gujarat &

High Court Of Gujarat|24 December, 2012

JUDGMENT / ORDER

When the petition is called out, learned advocate for the petitioner is not present.
Mr. Vishal C. Mehta, learned advocate, is present. He has made reference of the proceedings related to Criminal Misc. Application No.15151 of 2012, which is also listed alongwith present petition, and submitted that the petitioner in the said petition has not filed affidavit of direct service. Therefore, it is not clear as to whether the process issued pursuant to order dated 30.10.2012 has been served to the respondents or not.
Present petition is a fresh petition and it appears from the record that it has not been heard on merits until now though it was listed for admission hearing on 29.8.2012.
Since learned advocate for the petitioner is not present and Mr. Mehta, learned advocate, is not in position to conduct the matter. At his request, hearing is adjourned.
S.O. to 25.1.2013.
