Heard Sri Yogesh Kumar Srivastava, learned counsel for the applicants and Sri Som Veer, learned counsel appearing on behalf of opposite party no.2.
This application has been filed praying for transfer of the case nos.427 and 427 of 2013 (Uma Shanker Vs. Mahesh Chandra and others) under Section 406 I.P.C, Police Station Kotwali District Mathura, from District Mathura to District Firozabad.
It has been submitted that earlier another case between the parties under Section 13 of Hindu Marriage Act was transferred from Mathura to Agra bearing case no.571 of 2015.
In view of the fact, that no counter affidavit has been filed. The averments made in the affidavit filed in support of this applicant are treated to be correct.
This application is allowed.
The District Judge, Mathura is directed to transfer the record of aforesaid case to Judgeship Agra within a period of two weeks from the date of production of a certified copy of this order for assigning it to the appropriate court.
