The wife is before this Court seeking to transfer the H.M.O.P.No.178 of 2016 pending on the file of the Sub-Court, Devakottai, filed by the respondent/husband seeking of restitution of conjugal right to file of the Sub-Court, Pudukkottai.
2. Heard the learned Counsel appearing for the petitioner and the learned Counsel appearing for the respondent and perused the materials available on records.
3. Since the petitioner is living with her children in Gopalapuram Village, Piramanavayal P.O, Manamelkudi Taluk, Pudukkottai District, it may not be possible for a lady to travel from her native place to Devakottai.
4. Therefore, it is appropriate to transfer the H.M.O.P.No.178 of 2016 pending on the file of the Sub-Court, Devakottai, to Sub-Court, Pudukkottai and accordingly, H.M.O.P.No.178 of 2016 on the file of the Sub Court, Devakottai, is transferred to the file of Sub Court, Pudukkottai.
5. With the above direction, this petition is allowed. Consequently, connected Miscellaneous petition is closed.
