Heard learned counsel for the petitioners and learned Standing Counsel for the State-respondents.
Present petition has been filed with the following prayers:-
"(i) to issue a Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.2 to arms licence application no. 16 of 2020 for rifle to the petitioner no.1 (Smt. Kalpana Singh w/o Late Ramesh Singh within stipulated period."
(ii) to issue a Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.2 to arms licence application no. 17 of 2020 for rifle to the petitioner no.2 (Anand Singh s/o Late Ramesh Singh within stipulated period."
Learned counsel for the petitioners submitted that petitioners have filed an application nos. 16 & 17 of 2020 before the respondent no.2 for grant of arms licence, but till date same has not decided. Lastly, he submitted that a suitable direction may be issued to respondent no. 2 to decide the aforesaid applications of the petitioners at the earliest for which learned Standing Counsel for the State-respondents has no objection.
Considering the facts and circumstances of the case, this writ petition is disposed of with direction to respondent no. 2 to decide the aforesaid applications of the petitioners strictly in accordance with law within a period of three months from the date of production of certified copy of this order.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no. 2 to decide the applications of the petitioners after considering the Arms Acts, as well as Rules framed thereunder, Government Orders, Judicial pronouncement made by the Court & facts of the case.
