High Court Of Judicature at Allahabad|14 February, 2011

JUDGMENT / ORDER

Heard learned counsel for the applicant and learned AGA.
The applicant happens to be a person, who is said to be holding Lathi/Danda. According to the FIR allegation, he is the person, who is having bad reputation in the village and on account of his activities, it was not possible for the people of the village to live a peaceful life on account of which he was questioned by the injured. It is alleged that on this action of the complainant, the accused persons got infuriated and attacked the family members after entering into the house of the complainant. One lady died and one lady suffered injuries.
Learned counsel for the applicant has raised argument that there is discrepancy in the site plan and it has not been alleged that Lathi blow has resulted into the death of the deceased.
At this stage, I find that specific role has been assigned to all the accused persons and one woman died and one woman is injured. In these circumstances, no case for bail is made out.
The application for bail is accordingly rejected.
