The instant writ petition is directed against the order dated 10.07.2015 passed by the Deputy Director of Consolidation and the order dated 11.07.2014 passed by the Settlement Officer, Consolidation, Amroha.
The dispute arises out of an objection under Section 9A(2) regarding the shares of the parties in the land in dispute.
The Consolidation Officer decided the case in favour of the petitioner by his order dated 17.02.2014.
This order has been modified in appeal and the consequential revision dismissed, holding that the Consolidation Officer had passed the order relying upon the ex-parte evidence of the petitioner-objector.
At the appellate stage, the appellant also adduced their evidence and after appreciating the same the share have been suitably determined.
The Deputy Director of Consolidation, while dismissing the revision, has observed that there is no illegality, in so far as the determination of the shares by the appellate order is concerned. He has accordingly affirmed appellate order.
Even before this Court, counsel for the petitioner despite strenuous arguments could not point out any illegality in the determination of shares by the appellate order, impugned.
This Court is therefore, constrained to hold that the appellate and revisional orders are perfectly justified and warrant no interference.
The petition is accordingly, dismissed.
