Heard Sri S.K. Mishra, learned counsel for the petitioner, Sri N.K. Verma, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 18.9.2015 registered as case crime no. 250 of 2015 under sections 406, 409, 419, 420, 467, 468, I.P.C., police station Husainganj, District Fatehpur.
Learned counsel for the petitioners submits that petitioner is Headmaster in the institution in question. The Manager of the said institution, namely, Shatrughan has already been granted bail by the competent court. The allegation levelled against the petitioner is only for the offence under section 406, 409 I.P.C., hence the present F.I.R. against him is liable to be quashed.
Learned A.G.A. opposed the prayer for quashing of the F.I.R.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
The investigating officer of the present case shall conclude the investigation of the present case and submit the police report before the court concerned in accordance with law expeditiously preferably within a period of four weeks from today.
With the above direction this petition is finally disposed of.
