This application under Section 482 of the Code of Criminal Procedure has been filed by the accused kallu @ Shauaib @ Uvaish for quashing the order dated 28.4.2010 passed by the Additional Sessions Judge, Court No. 5, Sitapur passed in Sessions Trial No. 125 of 2004 (Crime No. 62 of 2001) State Vs. Fazil and Others under Sectons 302, 34 IPC, P.S. Sidhauli, District Sitapur by which the learned Additional Sessions Judge has rejected the application filed on behalf of the accused for his exemption from personal appearance and forfeiture of his bond and ordered for issuance of non- bailable warrant against him.
Heard learned counsel for the applicant.
I do not find any illegality or any misuse of criminal process in the impugned order. The application has got no force and is liable to be rejected.
The application is, therefore, rejected.
However, if the accused appears before the trial court within 15 days from today and moves any application for bail, the same will be disposed of by the Court preferably on the same date.
Till then no coercive steps will be taken by the trial court to procure the attendance of the accused.
