Madras High Court|07 December, 2009

JUDGMENT / ORDER

Heard, Mr.G.Arockiasamy, the learned counsel appearing on behalf of the petitioner and, Mr.S.C.Herold Singh, the learned Government Advocate, appearing on behalf of the respondent.
2. This contempt petition has been filed praying that this Court may be pleased to punish the respondent for contempt of Court for willfully disobeying the order passed by this Court, on 13.3.2009, in M.P(MD) No.1 of 2009, in W.P.(MD) No.1845 of 2009.
3. This Court, by an order, dated 13.3.2009, made in M.P.(MD) No.1 of 2009, in W.P(MD) No.1845 of 2009, had granted interim stay of the operation of the impugned order of the third respondent therein, dated 29.1.2009, made in Na.Ka.No.11692 A3/09. In such circumstances, the petitioner had stated that instead of the direct payment being made, the respondent ought to have paid the amount, due to the staff and the employees of the petitioner school, to the headmaster of the school.
4. The petitioner Mr.Alexandar had filed an affidavit, dated 2.11.2009, stating that he is, at present, functioning as the headmaster of the petitioner school and therefore, the respondent has to pay the amount to him.
5. The learned counsel appearing on behalf of the respondent had submitted that the amount, which is due to the staff and the employees of the petitioner school, as salary, had been paid to Mr.S.Alexandar, who had claimed to be the headmaster of the petitioner school, pursuant to the order of this Court, on 3.11.2009.
6. In such circumstances, in view of the submission made by the learned counsel appearing on behalf of the petitioner, since no further orders are necessary, the contempt petition stands closed. No costs.
