Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
The question involved in the present writ petition is regarding maintainability of the application before the Labour Court. Learned counsel for the petitioner placed reliance upon a judgment of the apex court reported in JT 2007 (2) SC 566; Ghaziabad Zila Sahkari Bank Ltd. v. Additional Labour Commissioner & others. The apex court has held that the application before the Labour Court against the employees of the Cooperative Society is not maintainable.
In view of the aforesaid fact, the petitioner is entitled for interim relief. Till the next date of listing, the operation of the award dated 05.03.2009 (Annexure-1 to the writ petition), shall remain stayed.
