This writ petition has been filed by the petitioners to issue a writ, order or direction in the nature of certiorari quashing the impugned FIR dated 26.4.2019 registered as Case Crime No.0142 of 2019 under sections 498-A, 323, 383, 307 I.P.C., P.S.-Shivkuti, District-Prayagraj.
Petitioner and respondent no.3 are practising advocates of this Court. Unfortunately both of them were involved in a matrimonial disputes, but now good sense has prevailed and they have mutually resolved the dispute amicably. Respondent no.3 has filed a short counter affidavit that she is no longer desirous to pursue the case.
No useful purpose wold be served by keeping the petition pending.
The writ petition is disposed of with the direction that if respondent no.3 or the petitioner as the case be apprises the I.O., concerned about the factum of amicable settlement, he shall proceed to file appropriate police report under Section 173 (2) Cr.P.C. without any delay. However if the I.O. concerned does not extend necessary cooperation, it shall be open for the petitioner to approach the S.S.P. concerned who shall be obliged to pass appropriate orders forthwith.
