Petitioner states that though he has been promoted to the post of Inspector but is not being sent on training on account of implication in a criminal case. Learned counsel for the petitioner points out that petitioner has already been acquitted by the competent sessions court on 1.4.2019 in Criminal Case No.5421 of 2016, under Sections 223, 224, 120-B, 193 and 211 IPC, Police Station Naka Hindola, District Lucknow. It is submitted that once petitioner has been acquitted, there is no justification for refusing permission to report for training.
Learned Standing Counsel states that in the event facts are brought to the notice of respondent no.3 then an appropriate decision would be taken in the matter.
In that view of the matter, this writ petition stands disposed of permitting the petitioner to represent his grievance before respondent no.3, who shall examine the same in accordance with law, and in the event petitioner has already been acquitted and no other adverse material exists against him, his claim for being sent on training shall be considered, within a period of two months from the date of presentation of a copy of this order.
