Heard Mr. Upendra Kumar Pushkar, learned counsel for the revisionist and Mr. Manish Kumar Dwivedi, learned counsel for the opposite party.
The criminal revision has been filed by the revisionist with a prayer to allow the present revision and set aside the judgement and order dated 7.9.2021 passed by the learned Additional Principal Judge, Family Court, in Case No. 951 of 2019 under section 125 Cr.P.C. P.S. Barla, District Aligarh.
Learned counsel for both the parties submit that since it is a matrimonial dispute, an opportunity be granted to the parties for reconciliation / settlement of their dispute by way of mediation. Revisionist is also willing to settle the matter through mediation.
Learned counsel for the petitioner proposed to deposit 50% of amount of arrears within three weeks in the Saving Bank Account of the O.P. No. 2 and rest shall also be deposited within a period of two months by March 2022. The said order of the learned Family Court is modified to the extent only to the arrears from the date of application to the date of order. The counsel for O.P. No. 2 shall provide details of the Saving Bank Account of the O.P. No. 2 to the revisionist.
The application is disposed of with the above directions.
