This criminal revision has been filed by the revisionist against the judgment and order dated 15.03.2013 & 24.01.2019 in Case Crime No.450 of 2010 (State vs. Kali Charan Sharma), under section 409 I.P.C., P.S.- Civil Lines, District- Moradabad.
Heard learned counsel for the revisionist.
Perused the record.
Much emphasis has been laid by the counsel upon the ailing condition of the revisionist. Reliance in this regard has been placed upon Annexure No.2 along with with a large number of medical papers with regard to the ailing condition of the revisionist have been filed. The revisionist-accused has been treated in District Hospital Moradabad and then was referred to Meerut. Submission is that in view of the serious ailments with which the revisionist is suffering, the adverse condition of jail may cost his life and he may therefore on medical ground be released on bail.

Summon the lower court record.
Notice on behalf of opposite party no.1 has been accepted by learned A.G.A.
Learned A.G.A. may file counter affidavit within three weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List this matter immediately after expiry of the aforesaid period along with lower court record before the appropriate bench.
In the peculiar facts and circumstances of the case, let the revisionist Kali Charan Sharma, convicted and sentenced in Case Crime No.450 of 2010 (State vs. Kali Charan Sharma), under section 409 I.P.C., P.S.- Civil Lines, District- Moradabad, be released on bail on his furnishing a personal bond and two solvent sureties each of his family members and/or relatives to the satisfaction of the court concerned.
As soon as personal and surety bonds are furnished, photostat copies of the same are directed to be transmitted to this Court forthwith by the concerned court below to be kept on record.
