Heard the learned counsel for the applicant and the learned AGA appearing for the State.
This application has been filed under Section 482 CrPC seeking a direction to the learned Trial Court i.e. District & Sessions Judge, Mathura to decide the ST No.692 of 2017 (State Vs. Ramu & Ors.) arising out of Case Crime No.102 of 2016, under Sections 498A, 323, 504, 307, 313 IPC & 3/4 DP Act, PS Mahila Thana, District Mathura expeditiously preferably within a stipulated period of time.
Learned counsel for the applicant has taken the Court through the order sheet and has shown that the case was committed to the sessions on 06.11.2017 but no charge has been framed in the case till date and the accused are seeking exemption from appearance on various dates.
The trial is young and it may not be appropriate to fix a calender for disposal of the trial. However, the Trial Court is directed to frame the charges subject of course to the right of the applicant to seek discharge and to any other legal impediment such as an interim order of stay from any Superior Court within a period of 15 days of receipt of certified copy of this order. In case charges as aforesaid are framed the Sessions Judge will proceed with and conclude the trial expeditiously without granting unnecessary adjournments to the accused.
With the aforesaid directions, this application is disposed of.
