Heard learned counsel for the petitioner and learned A.G.A.
This writ petition has been filed praying for the following reliefs:
"a) Issue writ, order or direction in the nature of certiorari quashing the impugned First Information Report dated 26.08.2020 lodged by the respondent no.3 registered in Case Crime No.0153 of 2020, under Section 2/3 U.P. Gangster Act and Anti Social Activities (Prevention) Act, 1986, Police Station Husainganj, District Fatehpur (Contained in Annexure no.1 to the writ petition) be quashed, otherwise the petitioner shall suffer huge an irreparable loss and injury.
b) Issue writ, order or direction in the nature of mandamus Commanding/Directing the respondents not to arrest the petitioner in pursuance of the impugned First Information Report dated 26.08.2020 lodged by the respondent no.3 registered in Case Crime No.0153 of 2020, under Section 2/3 U.P. Gangster Act and Anti Social Activities (Prevention) Act, 1986, Police Station Husainganj, District Fatehpur.
After the arguments were heard at some length, learned counsel for the petitioner states that the petitioners want to withdraw the writ petition and therefore, it may be dismissed as withdrawn with liberty to apply for bail.
Learned A.G.A. has no objection to the aforesaid request of the petitioner.
In view of the aforesaid, the writ petition is dismissed as withdrawn with liberty to the petitioner to apply for bail.
It is made clear that we have not expressed any opinion on merits of the case of the petitioner.
