Heard learned counsel for the petitioner as well as Sri Rajesh Kumar, learned Standing Counsel appearing for the respondents no. 1 to 4 and Sri Manoj Kumar Yadav, learned counsel appearing for the respondent no. 5.
Present writ petition has been filed seeking a writ of mandamus directing the respondent no. 3 to ensure handing over the lawful possession to the petitioner over his allotted house site situated at Khasra No. 47 M Area 0.012 hectare on western side within a stipulated time and also to direct the respondents not to interfere in lawful allotment of the petitioner over house site having Khasra No. 47 M Area 0.012 hectare, western side situated at Village Lalmanpur, Tehsil Sadar, district Jaunpur.
At the very outset, learned Standing Counsel states that the grievance of the petitioner can be suitably redressed by the respondent no. 2, the District Magistrate, Jaunpur before whom the petitioner has already submitted his representation annexed as Annexure-4 to the writ petition.
In such view of the matter, present writ petition stands disposed of with a direction to the respondent no. 2, the District Magistrate, Jaunpur to decide the representation of the petitioner, as expeditiously as possible, preferably within a period of two months from the date of production of a certified copy of this order.
The petitioner is at liberty to file fresh representation also placing any other relevant document on record alongwith certified copy of this order.
No costs.
