JUDGMENT / ORDER

Court No. - 59
Case :- CONTEMPT APPLICATION (CIVIL) No. - 2140 of 2018 Applicant :- Smt. Kalawati Opposite Party :- Rajendra Prasad Counsel for Applicant :- Ratnesh Kumar Srivastava
Hon'ble Yashwant Varma,J.
This matter had been adjourned on the last occasion to enable the learned counsel to address the Court on the issue of whether the Chairman, Board of Revenue is statutorily empowered to cancel the Khatauni. Today again when the matter is taken up all that the learned counsel refers to is Section 234 of the U.P. Revenue Code, 2006. This provision ex facie is only a regulation making power and does not confer any such authority.
Consequently, this Court finds itself unable to initiate proceedings in contempt.
The petition is dismissed.
Order Date :- 26.4.2018 Arun K. Singh
