Heard Ms. Pratima Singh, learned counsel for the petitioner and Ms. Jyotsna Srivastava, learned counsel for all the respondents and perused the record.
Present petition has been filed with a prayer to direct the respondent no. 2, 3 and 4 to consider the application of the petitioner dated 13.06.2018 and release the arrears of family pension of petitioner since 01.09.2014 to January, 2019.
At the very outset, learned counsel for the respondents has raised a preliminary objection that in view of Section 3(o)(i) of the Armed Forces Tribunal Act, 2007, present petition is not maintainable before this Court.
Learned counsel for the petitioner could not dispute the said position.
Present petition is accordingly dismissed as not maintainable on the ground of aforesaid objection.
No order as to costs.
