Petitioners are A1 to A8. They seek for quashment of C.C No. 135 of 2014 on the file of Additional Junior Civil Judge, Chirala, Prakasam District. They allegedly committed offences under Section 498-A of IPC as well as under Sections 3 and 4 of Dowry Prohibition Act.
The offences are triable by a Magistrate of First Class.
Petitioners have the chance of moving the trial Court for discharge. Without availing the alternative remedy available to them, the petitioners straightaway approached this Court under Section 482 Cr.P.C. Petitioners may move the trial Court for discharge.
Consequently, this Criminal Petition is disposed of granting liberty to the petitioners to move the trial Court for discharge. The presence of the petitioners before the trial Court is dispensed with for a period of three weeks to enable the petitioners for approaching the trial Court for appropriate relief. Miscellaneous Petitions, pending if any in this Criminal Petition, shall stand closed.
