This application is preferred by the brother-in-law of the applicant, a life convict, on the ground that father of Kalabhai Hamirbhai Kachhot-the convict died on 20.5.2012 and death certificate is issued by the competent authority under Registration of Births and Deaths Act, 1969. The xerox copy is annexed with the application. The original death certificate so issued is shown to this Court. It is also stated that another brother of the convict also died on 22.11.2006 and no other member in the family is available to perform obsequies rituals and other rituals as per Hindu customs and, therefore, it is requested that by imposing suitable conditions, the applicant be granted temporary bail.
Considering the above aspect and the death certificate of the father of the applicant, as produced and recorded hereinabove, I am inclined to grant 10 (ten) days of temporary bail from the date of release of the applicant-convict on furnishing personal bond of Rs.2,000/- (Rupees two thousand only) to the satisfaction of the jail authority and shall surrender in time on expiry of the period of temporary bail.
After release, the applicant shall report to the nearest police station of village Koilana of Taluka Manavadar once during the period of temporary bail.
The application is allowed accordingly. The Registry to forthwith communicate this order to the jail authority and direct service is also permitted.
