This bail application has been filed with a prayer to enlarge the applicant on bail in Crime No. 34/247 of 2010 under Section 304B I.P.C., P.S. Jhijhana, District Allahabad.
Heard learned counsel for applicant, learned A.G.A. and perused the record.
Learned counsel for the applicant submitted that while cooking food, wife of the applicant caught fire and due to accidental burn injury subsequently she expired. However, on the basis of false allegation, first information report was lodged. Subsequently the affidavit was filed by the informant as well as the father of the deceased and even an application was given to the Chauki-in- Charge Chausana, P.S. Jhijhana, District Muzaffarnagar signed by the informant and other family members and witnesses. A number of person has signed on the compromise application dated 20.03.2010. It was further submitted that the marriage of the applicant took place 7-8 years before the incident, however, according to F.I.R. also the marriage took place before 6 years to the incident. The applicant is in jail since 17.03.2010.
In view of the above, without expressing opinion on merit, let the applicant Kala @ Kiran Pal be enlarged on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned in Crime No. 34/247 of 2010 under Section 304B I.P.C., P.S. Jhijhana, District Allahabad.
