JUDGMENT / ORDER

When the application came up for hearing today, the learned Public Prosecutor submitted that, they have issued only a notice under Section 160 of the Code of Criminal Procedure to question the petitioner and at this stage, they have no intention to arrest him or to implicate him an accused. 2. When this was pointed out, the counsel for the petitioner submitted that, he is prepared to appear before the investigating officer on a date fixed by this court. The Public Prosecutor replied that, if he appears, they will not arrest him and if they want to arrest, they will issue a fresh notice under Section 41(A) of the Code of Criminal Procedure to the petitioner.
So the petitioner is directed to appear before the investigating officer on 14.10.2014 at 10.00 a.m., and after B.A. No.7159 of 2014 2 interrogation, he can be left and they want to arrest him, they will have to issue a notice under Section 41(A), stating the reason for the arrest to the petitioner.
With the above direction, the petition is disposed of.
