(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Rule returnable on 21st August 2012. Having heard learned counsel, Ms.Chandarana, and having regard to the facts and circumstances of the case, including the facts that the deceased husband of the respondent was dismissed from service only on the charge of unauthorized absence for eight days, after an ex parte enquiry, and at the time the final order of punishment was made in revision he had already passed away, limited ad-interim relief subject to further and final orders herein is granted to the extent that the salary and allowances payable to the respondent for the period from 5.9.1999 till the date of his death shall be paid to the extent of 25% to the respondent, on condition that the pensionary benefits shall be paid to the respondent on the basis that he had been in continuous service till the date of his death.
