Jitender Reddy … Appellant And The Government of Telangana Rep. by its Principal Secretary Education Department Secretariat Buildings Hyderabad and others … Respondents THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL NO.1114 OF 2014 JUDGMENT: (per the Hon’ble Sri Justice Sanjay Kumar) This appeal is preferred by the petitioner in W.P. No.22323 of 2014 aggrieved by the dismissal of its petition for interim suspension of the impugned proceedings dated 2.8.2014. By the said impugned proceedings, the Regional Joint Director, School Education, Hyderabad, withdrew the permission/recognition of the petitioner school. The learned Judge dismissed the miscellaneous petition filed by the petitioner school seeking suspension of the impugned cancellation proceedings holding that the petitioner could not wash its hands off and avoid responsibility for the incident for the reason that the driver employed by the petitioner school was also expected to take adequate care to ensure that he did not cross the railway track when a train was approaching. The learned Judge also took note of the relevant statutory rules, which require the management of the petitioner school to ensure safety of the children studying therein.
In the light of the reasoned exercise of discretion by the learned Judge in denying interim relief, we are not inclined to entertain this appeal or grant any order at this stage.
The writ appeal is devoid of merit and is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
